Vacation Rental Agreement
VACATION RENTAL AGREEMENT This rental agreement is entered into by and between the renter/primary guest that books through the platform hereinafter referred to as “GUEST(S)” and SFP III, LLC hereinafter referred to as “OWNER”.
This agreement constitutes a contract between the GUEST(S) and OWNER. Please read this Vacation Rental Agreement thoroughly. Any money received by Owner for occupancy of vacation property indicates the acceptance of the terms and conditions of this Vacation Rental Agreement. It is the responsibility of the GUEST(S) to be familiar with all policies within this agreement. This occupancy will be in the form of a Vacation Rental only and does not constitute a permanent or primary residence or other tenancy. Rental Property physical address:

TERM OF AGREEMENT: The rental period begins at 4 p.m. EST on the “Check-in Date” and ends at 11 a.m. EST on the “Check-out Date”. These dates are shown in your reservation confirmation with the listing platform.
APPROVAL OF THIS AGREEMENT: By booking through any platform the primary guest and all other guest agree to this Vacation Rental Agreement and House Rules. The primary GUEST agrees to give names and ages (adult, adult age 18-25, minor under age 18) of each occupant.
SMOKING: This is a NON SMOKING property. No smoking is allowed inside of the unit whatsoever. Smoking is not allowed in the lanai or within eight (8) feet for the front door. Any GUEST or their guests not adhering to the No Smoking policy will result in automatic forfeiture of security deposit as well as immediate removal from premises.
RENTAL RULES: GUEST agrees to abide by the House Rules attached to the Vacation Rental Agreement and otherwise posted. GUEST at all times while at the property and shall cause all members of the rental party and anyone else GUEST permits on the property to abide by the following rules at all times while at the property. This includes but is not limited to an age requirement policy of one (1) parent or guardian over age of 25 to be present and staying in the property for every 3 guests between the ages of 15-25, and a MAXIMUM OCCUPANCY of 6 total persons (as listed in this agreement) that is a requirement of and strictly enforced by the local home owner’s association (HOA).
SECURITY DEPOSIT: A security deposit of $500 is required for VRBO, website and direct bookings. This must be received prior to check-in. The security deposit is NOT applied toward the rental amount; however, it is a preauthorization hold that is lifted within (5) days of departure, provided the following provisions are met. GUEST may be responsible and liable to OWNER for damages in excess of the security deposit for any damage or loss caused by GUEST or its guests. The security deposit will be returned if: a) No damage is done to property or its contents, beyond normal wear and tear. b) No charges are incurred due to contraband, pets, smoking, or collection of rents or services rendered during the stay. c) No excessive cleaning required. All debris, rubbish and discards are placed in trash receptacles and soiled dishes are cleaned and put away. d) No excessive utility charges are incurred. e) No linens/towels are lost, stolen, or damaged. f) The GUEST (or any of GUEST’S visitors) is not removed by the OWNER (or representative of the OWNER), or the local law enforcement.
PAYMENT: An advance payment equal to 50% of the rental total is required to confirm reservations. The advance payment will be applied toward the property rental price. A Credit/Debit Card will be maintained on file for incidentals and charging in accordance with this Agreement. GUEST agrees to keep a valid payment method on file with OWNER or booking platform. Failed payments may constitute a cancellation by GUEST. The advance payment is not a damage deposit. The BALANCE OF PAYMENT is due prior to your Check-In date.
CANCELLATIONS: Cancellations made through a booking platform are subject to the cancellation policy specified in the reservation. For all others: Notice in writing or through original booking system is required for cancellation. Cancellations made more than thirty (30) days before check-in date will receive a full refund. Cancellations made between 14 and 30 days of check-in will receive 50% refund of the amount paid. Within 14 days no refund will be made. Cancellations or changes that result in a shortened stay that are made within thirty (30) days of the Check-in date, will be refunded only payment for cleaning fees and security deposit. Early departure does not warrant any refund.
ADDITIONAL CHARGES: All "normal" utilities are included. GUEST will be charged additional fees for the following: ● Entertainment charges for any programing ordered during the rental period in addition to the provided entertainment. ● Excess cleaning or laundry expenses. ● Fines or summons imposed by a local authority, home owners association as a result of your actions. ● Any damage to the condo or its contents. ● Excessive utility usage.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretenses will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check-in.
GUEST/PARTIES/NOISE: The GUEST must supervise their guest(s) while on the premises. Noise in the unit must be kept to a reasonable level as not to cause a disturbance to the neighbors or general public. HOA and Local Sarasota County noise ordinances limit outside noise between the hours of 10:00pm - 7:00am. In no event may the MAXIMUM OCCUPANCY (as listed below in this Agreement) be exceeded without written consent. No parties or large gatherings are permitted in this unit.
MAXIMUM OCCUPANCY: The maximum number of overnight guests for this property is limited to 6 persons. Maximum occupancy for this property shall not exceed the number of persons that GUEST registers on the reservation without prior consent from OWNER. If GUEST exceeds the maximum occupancy, GUEST and any and all of their guests are subject to immediate removal and forfeiture of their security deposit and rental payment.
ILLEGAL DRUGS: Under no circumstances shall any illegal drugs be allowed on the property. GUEST understands that possession and use of any such substance is grounds for immediate removal of GUEST and forfeiture of payment. GUEST further waives any and all rights to recourse against the OWNER for enforcing this clause.
FIREWORKS: Fireworks are prohibited anywhere in the neighborhood and among or from any of the units.
CLEANING: No cleaning service is included during the GUEST’S stay. Cleaning service charges in excess of the standard cleaning fee will be deducted from the Security Deposit if required. Rates include a one-time linen-towel preparation, bed sheets setup, toilet paper, and paper towels. Upon departure strip all used beds and leave unmade. All dinnerware, pots, pans, glasses should be cleaned and put away. Please discard used food from the cabinets and refrigerator. GUEST will be charged for excessive linens and/or unwashed dishes. Trash should be taken to the dumpster outside.
MAINTENANCE: It is expected that major systems in and around the unit will break down from time to time such as air conditioning, washer, dryer, refrigerator, etc. OWNER will attempt to repair the problem as soon as possible upon notice by the GUEST. OWNER assumes no liability to GUEST if such should occur as all products have a useful life and break down occasionally.
GUEST RESPONSIBILITIES: All occupants are required to perform "normal" household duties that include, but are not limited to: ● Garbage removal ● Cleaning of individual and guest dishes and putting all dishes and items back ● Cleaning all counter spaces, sweep floors if needed ● Removing all bedding and put on bed ● Placing used towels on floor in bathrooms upon check-out ● Cleaning all beach items outside. If needed spray off using the hose outside the front door. Please do not put up beach items full of sand ● Notifying the OWNER of any damages or problems with the property ● Locking of all doors and windows when GUEST leaves the unit.
