We love that we can share our home with you but please treat the home, belongings, and property with care. We reserve the right to remove guests without refund for violating these house rules, misuse of the space as a short-term lodging accommodation, or conduct that disturbs the general peace and comfort of other guests, managers, property caretakers, and homeowners.
1. Property has a septic system. Do not flush anything other than toilet paper. No feminine products or “flushable” wipes should be flushed at any time. Clogging the septic system could result in damage charges exceeding $1,000.
2. Pool: Guest understands that a pool is available on the property for their use. Guest assumes any and all liability from use of said pool. No glass of any kind is permitted in or near the pool. If broken glass is found in the pool, guests may be responsible for the cost to drain and clean the pool.
3. Parents/Guardians must closely supervise their toddlers and children at all times.
4. Well-behaved and well-trained pets may be permitted with prior approval from the host. An add'l fee of $150 for first pet $100 for second pet (2 pets max) applies. Pets must be treated with flea & tick preventative and up-to-date on shots.
5. No Unregistered Guests. Please abide by occupancy limits. People other than those set forth above may not be on the property at any given time. Any person on the property is the sole responsibility of Guest. If there are more guests than disclosed at booking, Guest will be charged $50 per additional guest for each day of the reservation and all guests may be evicted without refund and a $250.00 service fee.
6. The property is privately owned; the owners or property manager are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners and their representatives are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
7 No illegal substances are to be used, sold, or distributed on the property.
8. No parties and/or loud music. Quiet hours are from 10pm-7am. Please respect the neighbors' privacy. Excessive noise may result in termination of your stay without refund and a $250.00 service fee.
9. Keep the property and all furnishings in good order. If any furniture is moved, please move it back to its original position upon checkout.
10. No Smoking. The security deposit will automatically become forfeited for smoking indoors and add'l remediation expenses may be imposed.
11. Only use appliances for their intended uses.
12. Parking: Max 7 vehicles inside property. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
13. Housekeeping: Please keep the home tidy and remove all trash at checkout. There is no daily housekeeping service. Do not leave wet towels on the furniture.
14. Checkout is at 11AM. Late checkouts may be subject to a $100/hr fee.
15. If any fines, damage, or liability are incurred because of guest’s use of the premise whether due to HOA violations or otherwise. Guest will be responsible for such payment.
16. We encourage Guest to purchase a travel insurance policy that will allow you to cancel for any reason.
RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
IN CONSIDERATION for being permitted to enter premises and property for vacation rental, the undersigned, for himself/herself, his/her personal representatives, guests, children, heirs, and next of kin, acknowledges, agrees, and represents that he/she has or will immediately upon entering, and will continuously thereafter, thoroughly inspect such areas and his/her continued presence constitutes an acknowledgment that he/she has inspected house, deck and entire property and he/she finds and accepts such areas as being safe and reasonably suited for the purposes of his/her use, and he/she further agrees and warrants that if, at any time, he/she feels anything to be unsafe, he/she and all guests will immediately leave the area and advise appropriate persons.
THE UNDERSIGNED hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Project T2L2 LLC, their members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as “releasees”, from all liability to the undersigned, guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area.
THE UNDERSIGNED hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees, natural risky conditions or otherwise.
THE UNDERSIGNED hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of the releasees, or otherwise while in or upon area.
THE UNDERSIGNED hereby certifies that he/she and guests (they) have adequate insurance to cover any injury or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The undersigned further that he/she/they have no medical conditions which would interfere with use of swimming, canoeing, rafting, climbing stairs, etc. or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage. The undersigned further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance to the rules of the American Arbitration Association, except to the extent modified below.
THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.
POOL WAIVER
I wish to swim at the pool facilities during the length of stay at this vacation home. By swimming in the vacation home pool, I recognize and fully understand certain things, including:
• At no time is there a lifeguard on duty, you (the Guest) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay.
• My use of the pool facilities during my stay involves certain risks, including but not limited to:
1. The risk of injury resulting from possible malfunction of the pool equipment;
2. The risk of injuries resulting from tripping or falling over obstacles in the pool area;
3. The risk of injuries resulting from unsupervised divers and swimmers colliding;
4. The risk of other injuries resulting from participating in any action in the pool.
• I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming.
In exchange for the Owner and Manager allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area;
2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES;
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area
4. That I am over the age of 25 and that I am responsible and will adhere to all the rules of the property;
5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate.
I have read and understood this document. I am aware that by making this booking, I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so. By accepting the reservation, you are accepting this indemnity agreement.
